I am currently engaged in challenging the Wyoming Controlled Substances Act as facially unconstitutional: as it is an arbitrary, non-uniform, special law due to the exclusion of alcohol and tobacco from the Act’s “authority to control”.

Arbitrary, non-uniform and “special” laws by definition violate a person’s due process and equal protection rights guaranteed by both State and Federal Constitutions.

It is essential to recognize that current drug laws differentially impact Cognitive Liberty, our right to alter our mental functioning as we see fit, for no other reason than the choice of drug to which one orients, i.e. our Drug Orientation. If it’s a “controlled substance” it’s a no-no. And yet, without free thought, our right to free speech is meaningless.

Should my arguments win, the Wyoming CSA will be struck from the books.

This argument is currently applicable to the Federal CSA as it contains identical language and provisions.
